5. What are the consequences of De-Forested area Rubber Farms?

Farms that have been deforested after December 2020 are subject to stringent regulations, specifically targeting rubber producers aiming to access the EU market. Rubber sourced from these deforested areas is deemed non-compliant, making it ineligible for export to the EU. Rubber farmers, dealers, processors, and exporters who are accessing EU market will face the following consequences if the rubber is from deforested farms:

• Farmers whose rubber plantations are located on deforested land will no longer be able to sell their rubber to operators or traders targeting the EU market.
• Deforested area rubber farms are still allowed to supply for local Indian consumption.
• Dealers handling rubber from farms identified as deforested will face trade restrictions and may be unable to sell their products to exporters and EU markets.
• Dealers handling rubber from farms identified as deforested will face trade restrictions and may be unable to sell their products to exporters and EU markets.

Exporters who export rubber procured from deforested farms will be subjected to:

• Fines of up to 4% of the company’s total annual EU-wide turnover for the financial year
• Confiscation of non-compliant rubber
• Potential exclusion from the EU market in case of repeated or significant violations of the EUDR
• India is disputing EU’s classification of deforested and non-deforested areas. EU may implement revised maps once the clarifications are received from Government of India.

• High-risk farms receive detailed action plans, including sustainable agricultural practices and steps for reducing deforestation risk.
• If required, we provide regular audits and reviews to ensure compliance progress, offering recommendations for any corrective actions needed.
• If stakeholders raise issues related to incorrect deforestation classification, we work with local authorities to review and adjust records based on legitimate claims.
